BAS agent superannuation services expanded

BAS Agent, superannuation services, Tax Agent Services (Specified BAS Services) Instrument 2016The range of superannuation-related services a BAS agent can provide has been expanded.

“The Tax Practitioners Board (TPB) has expanded the scope of services Business Activity Statement (BAS) agents can provide beyond existing BAS services, as defined in the Tax Agent Services Act 2009,” said the TPB.

The TPB says a BAS agent can now:

  • provide services under the Superannuation Guarantee (Administration) Act 1992 to the extent that they relate to a payroll function or payments to contractors,
  • determine and report the superannuation guarantee shortfall amount and any associated administrative fees,
  • deal with superannuation payments made through a clearing house,
  • complete and lodge the Taxable payments annual report to the ATO, on behalf of a client,
  • send a tax file number declaration to the Commissioner, on behalf of a client, and
  • apply to the Registrar for an Australian Business Number, on behalf of a client.

These changes are contained in the Tax Agent Services (Specified BAS Services) Instrument 2016, which was made by the Tax Practitioners Board following a consultation process..

“We know there are services that are commonly provided by BAS agents that do not necessarily fall within the definition of a BAS service,” said Chair of the TPB, Ian Taylor.

“This legislative instrument now allows these to be included in the services that BAS agents can provide, without the requirement to be a registered tax agent,” he said.

The ATO said, about the expanded BAS agent services: “We will keep you informed about how you can action these services via our Portals and other digital services in the coming weeks.”

  1. I like that BAS agents can now apply for a business number on behalf of their clients. That will make it much easier on business owners. What is the process that takes place to make these changes? Thanks for the information!

    1. The change in the rules was made by Tax Practitioners Board, but the ATO still needs to update their systems – I don’t know when this is expected to be completed.
